Guardianship refers to the person and not his/her property. If the Court determines a Guardianship is needed, an Order Appointing Guardian will be signed and filed.
Conservatorship refers to the protection of a person's estate or property and is filed when a person is in need of monetary management. For an Adult Conservatorship, the Court must find the adult is incapable of managing his/her own affairs. The Court may appoint an attorney, physician or investigator for the individual to report to the Court as to the individual's incapacity. If the Court determines that a Conservatorship is needed, an Order Appointing Conservator will be filed.
Guardianship/Conservatorship cases are filed when both a person and his/her assets are in need of management.
