Tucson man indicted on drive-by shooting charges

Florence, AZ – A 29-year old Tucson man was indicted for aggravated assault, drive-by shooting and narcotics offenses stemming from a an Aug. 8, 2012 incident that began in Pima County and ended in Picacho, Pinal County.

 

A Pinal County Grand Jury returned an eight-count indictment charging Augustine Hector Bernal with two counts of aggravated assault with a deadly weapon, both class 3 dangerous felonies; drive-by shooting, a class 2 dangerous felony; endangerment, a class 6 felony; possession of marijuana for sale, , a class 2 felony; transportation and importation of marijuana in the state for sale, a class 2 felony;  criminal damage, a class 6 felony;  and misconduct involving weapons, a class 4 felony.

 

“Violent acts like this destroy the sense of security and safety of our residents. We must hold people accountable for their actions,” said James P. Walsh, Pinal County Attorney. “My office will aggressively pursue the prosecution of this case.”

 

According to the indictment, Bernal shot at the victim in Tucson and pursued her westbound on Interstate 10. The incident ended near Picacho, Pinal County. Department of Public Safety officers responded to the incident investigated the case and arrested Bernal.

 

Bernal was arraigned on August 17, 2012 in Florence, at Pinal County Superior Court for both crimes, and was booked into the Pinal County Adult Detention facility on a $500,000 bond.
