Miguel Tapia, 21 of Maricopa, arraigned on Second Degree Murder

FLORENCE, AZ (6/6/14) - This morning, Miguel Tapia, 21 of Maricopa, was arraigned in Pinal County Superior Court on one count of 2nd Degree Murder and one count of Tampering with Physical Evidence.

The PC Statement indicates that Officers responded to a residence in the 44000 block of West Cydnee Drive in Maricopa, AZ, on May 16, where they discovered the decedent, Holly Berry, 43, of Maricopa.

According to the Maricopa Police Department, “the Department of Public Safety Criminal Investigation Unit team responded to assist with processing the extensive scene.”

Tapia was indicted on May 28 by a Pinal County Grand Jury on one count of Second Degree Murder, a Class 1 Felony and Tampering with Physical Evidence, a Class 6 Felony.  Tapia is presumed innocent until and unless proven guilty.

If convicted, a Second Degree Murder charge possesses a sentencing range of 10 to 22 years in prison, with 16 years being the presumptive.

Pinal County Attorney Lando Voyles stated, “No person should live in fear and no relationship should include abuse or violence.  If you or someone you know is living in an abusive relationship, contact law enforcement before it’s too late.  In 2012, at least 139 individuals lost their lives in Arizona due to domestic violence fatalities, according to the Arizona Coalition Against Domestic Violence.”
